{"id":32099,"date":"2025-03-29T00:28:14","date_gmt":"2025-03-29T00:28:14","guid":{"rendered":"http:\/\/www.16news.com.au\/?p=32099"},"modified":"2025-03-29T00:28:14","modified_gmt":"2025-03-29T00:28:14","slug":"nsw-government-passes-legislation-banning-claim-farming","status":"publish","type":"post","link":"http:\/\/www.16news.com.au\/index.php\/2025\/03\/29\/nsw-government-passes-legislation-banning-claim-farming\/","title":{"rendered":"NSW Government passes legislation banning \u2018claim farming\u2019"},"content":{"rendered":"\n<p>The NSW Government has passed legislation banning the practice of \u2018claim farming\u2019 where vulnerable people are pressured to lodge civil compensation claims.<\/p>\n\n\n\n<p>The&nbsp;<em>Claim Farming Practices Prohibition Bill 2025<\/em>&nbsp;which passed parliament last night prohibits a person from contacting someone to solicit a claim and buying or selling claims.<\/p>\n\n\n\n<p>Claim farmers often target child abuse victim-survivors through cold calling and use unethical, high-pressure tactics to solicit a claim. This person\u2019s details are then sold to a legal practice or another claim farmer.<\/p>\n\n\n\n<p>Claim farmers may obtain a person\u2019s information without their consent and make promises about legal entitlements that are untrue or not in the claimant\u2019s best interests.<\/p>\n\n\n\n<p>Under the new laws, anyone who solicits, buys or sells a claim faces a fine of up to $55,000. Lawyers will also be prohibited from charging or retaining fees associated with a claimed farm.<\/p>\n\n\n\n<p>The bill covers claims arising under the&nbsp;<em>Civil Liability Act 2002&nbsp;<\/em>including<em><\/em>serious injury, medical negligence, and public and product liability as well as intentional torts.<\/p>\n\n\n\n<p>Intentional torts include acts such as child abuse, assault and deprivation of liberty.<\/p>\n\n\n\n<p>Existing offences such as fraud will still apply in addition to the claim farming prohibition for fraudulent claims.<\/p>\n\n\n\n<p>The existing offence of dishonestly obtaining financial advantage by deception currently carries a maximum penalty of 10 years\u2019 imprisonment.<\/p>\n\n\n\n<p>The ban on claim farming does not prevent abuse victims from bringing a claim for compensation by contacting a lawyer directly.<\/p>\n\n\n\n<p>It also does not prevent someone from giving advice or assistance to another person to encourage them or to assist them in making a claim.<\/p>\n\n\n\n<p><strong>Attorney General Michael Daley said:<\/strong><\/p>\n\n\n\n<p>\u201cThe NSW Government has legislated to put a stop to the insidious practice of claim farming that exploits the trauma of vulnerable people.<\/p>\n\n\n\n<p>\u201cThe predatory practices can worsen the trauma and distress experienced by victim-survivors.<\/p>\n\n\n\n<p>\u201cNo one should be harassed or intimidated into making a civil compensation claim which may not be in their best interests.<\/p>\n\n\n\n<p>\u201cThis ban has been developed in close consultation with the community including victim-survivors and their advocates.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The NSW Government has passed legislation banning the practice of \u2018claim farming\u2019 where vulnerable people are pressured to lodge civil compensation claims.
